Real estate CEO sues Kmart for $205,000 over a slip-and-fall incident inside their store

There will always be potential hazards that can lurk even in the most mundane of places, so we must remain vigilant about the impact they can have on our lives.

Case in point: A prominent real estate boss is taking legal action against retail giant Kmart and shopping centre conglomerate Westfield, following an incident that resulted in severe injuries.

Brooke Joan Willis, a 34-year-old Property Management Agency owner, experienced this unfortunate incident while exiting a Kmart store located in Carindale, Brisbane, on February 26, 2022, when she slipped and fell on a puppy pad inside the store.

The incident occurred amidst flooding in Brisbane, and the puppy pad, typically used for housetraining dogs, had been placed by Kmart staff to absorb a leak from the ceiling.

Now, Willis is seeking damages amounting to $205,000.

According to the claim filed in the District Court in Brisbane, Willis alleges that the fall resulted in 'considerable pain and suffering and mental anguish', as well as a 'permanent partial disability'.

The incident left her with a broken bone in the forefoot called metatarsal and a fracture to the cartilage wrapped in her ankle bones.

Adding to the complexity of the situation, Willis was pregnant at the time of the accident.

She claims that she was unable to walk for two weeks following the incident. Today, she also allegedly struggles with wearing high heels, experiences occasional swelling and pain, and finds it challenging to stand, walk, or run for extended periods.

Willis also anticipates that she may need to undergo surgery on her ankle in the future.

The lawsuit has been filed against Kmart Australia Limited and Scentre Shopping Centre Management (Qld) Pty Ltd.

Willis, who owns Brooke Willis Property and has previously worked with Ray White and AUMR Property Management Group, is claiming potential future economic loss due to her injuries.

She also cites additional costs incurred for hiring extra staff to manage her business during her recovery.

As of now, a defence has not been filed, and a date for the next hearing has not been set.

Why do people have to sue everyone just because they had an unfortunate accident. A puppy pad is not very big, is that the only place she could walk? I would say more embarrassment than mental suffering.

Why on earth did she step on it? Most normal people would step over or around it. Puppy training pads aren't big and you can clearly see they have plastic under them! Accidents happen but often averted if people used their brain and were vigilent.

There are few things here that raise questions.
How does one fracture cartilage wrapped in ankle bones?
What added complexity if she was pregnant? Unless of course some injury was sustained.
And just don't wear such high heels.

Some people will sue for anything. Why did she step on the pet pad & it certainly wouldn't have cost her $205,000. I slipped on wet grass 10yrs ago & it was my own silly self who should have known better. I still have a limp & now arthritis, but I certainly didn't sue my Landlord.

I had to have my plate & screw taken out a few years later as the screw became loose & caused an ulcer from having to push my terminally ill husband in a wheelchair a few times a day up a steep hill, swollen ankles, unable to do what I could back then, silly me for not sueing it seems. I could have been rich😊

1..K Mart should have had appropriate signage informing of the slip hazard.
2.. The woman should have been vigilant as to the fact of recent flooding and should have been watching where she was walking.
3..Good luck sueing K Mart.

Seriously..couldn’t see the object on the floor? I’m glad she and baby were ok but why would you walk over something like that in the first place??? Just saying….

On a completely different note - what a good idea to use a puppy pad to absorb the drips

Her Business will surely flourish after this publicity.

At a shopping centre my wife had a fall on a travelator when a woman with a trolley load of shopping failed to control the trolley knocking into my wife & knocking her forward on to the travelator. Shr tried to stand but couldn't be abuse she was still on the travelator. Only the quick thinking of a shopper helped when she hit the Emergency stop button. Security staff arrived, took statements & told her submit medical accounts. A visit to Emergency at the Hospital revealed a fractured wrist which took a while to heal& still causes pain.

AT NO TIME WAS THERE EVER A THOUGHT TO SUE ANYONE!
