Case in point: A prominent real estate boss is taking legal action against retail giant Kmart and shopping centre conglomerate Westfield, following an incident that resulted in severe injuries.
Brooke Joan Willis, a 34-year-old Property Management Agency owner, experienced this unfortunate incident while exiting a Kmart store located in Carindale, Brisbane, on February 26, 2022, when she slipped and fell on a puppy pad inside the store.
The incident occurred amidst flooding in Brisbane, and the puppy pad, typically used for housetraining dogs, had been placed by Kmart staff to absorb a leak from the ceiling.
Now, Willis is seeking damages amounting to $205,000.
According to the claim filed in the District Court in Brisbane, Willis alleges that the fall resulted in 'considerable pain and suffering and mental anguish', as well as a 'permanent partial disability'.
The incident left her with a broken bone in the forefoot called metatarsal and a fracture to the cartilage wrapped in her ankle bones.
Adding to the complexity of the situation, Willis was pregnant at the time of the accident.
She claims that she was unable to walk for two weeks following the incident. Today, she also allegedly struggles with wearing high heels, experiences occasional swelling and pain, and finds it challenging to stand, walk, or run for extended periods.
Willis also anticipates that she may need to undergo surgery on her ankle in the future.
The lawsuit has been filed against Kmart Australia Limited and Scentre Shopping Centre Management (Qld) Pty Ltd.
Willis, who owns Brooke Willis Property and has previously worked with Ray White and AUMR Property Management Group, is claiming potential future economic loss due to her injuries.
She also cites additional costs incurred for hiring extra staff to manage her business during her recovery.
As of now, a defence has not been filed, and a date for the next hearing has not been set.
