I did some research :

In Tennessee USA, if an intruder attempts to forcefully and without permission enter a property, the owner or appointed security has the right to shoot them without warning.

Trespass is first and foremost a criminal offense and the person can face a civil lawsuit and saddled with a criminal record. There is also a Law in Tennessee USA regarding “Disturbing the Peace” (offensive conduct) which also carries fines.

Criminal trespass is a class C misdemeanor that carries penalties of up to 30 days in jail and a $50. The same applies to disorderly or offensive conduct (Class C misdemeanor) carrying a fine of up to $50 and jail time of up to 30 days in jail.

In summary this guy should have been jailed for 60 days and paid $100 fines.
