Dr James Metzger from UNSW Law reminded us, 'If Congress wants to supersede an executive order, then Congress can pass a law that covers the subject area that the executive order covers.'

Moreover, the courts serve as another formidable barrier to unchecked executive power.


They can deem an executive order unconstitutional, as was when President Harry S. Truman attempted to nationalise the steel industry in 1952, only to be rebuffed by the Supreme Court.

Let's delve into some of President Trump's most contentious executive orders that are currently under fire:

1. Ending Automatic Birthright Citizenship:

Trump's executive order to end automatic U.S. citizenship for children born to immigrants without legal status has been met with immediate legal challenges.

Advocacy groups like the ACLU argued that this order violates the 14th Amendment of the U.S. Constitution, which grants citizenship to all persons born or naturalised in the United States.

Legal experts and civil rights organisations are fighting to uphold the fundamental American promise of equality at birth.

2. Only Recognising Two Genders:

In a move that has reversed the previous administration's policies on gender identity, Trump's order to remove 'gender ideology guidance' from federal communications has been met with backlash from LGBTQ+ rights groups.

The Human Rights Campaign has vowed to combat the 'harmful provisions' of the order, which they see as an attack on the recognition and protection of all gender identities.


3. Ordering All Federal Employees to Work from the Office:

Trump's directive for all federal workers to cease remote work arrangements and return to the office full-time has raised practical and legal concerns.

Enforcing this order could prove challenging, with a significant portion of the federal workforce covered by union agreements that include remote or hybrid work provisions.

Non-union workers, while subject to return to the office, are entitled to a 30-day notice and an opportunity to respond, complicating the implementation of this order.

4. Labelling Drug Cartels as 'Foreign Terrorist Organisations':

The decision to classify drug cartels as foreign terrorist organisations carries potential national security implications.

While intended to strengthen the fight against narcotics trafficking, experts like Mike Vigil, former head of the DEA's foreign operations, suggested that the impact on cartels' day-to-day operations may be minimal, given that many anti-terrorism powers are already in use in Mexico.


These executive orders have ignited a firestorm of legal battles and public discourse, raising questions about the limits of presidential power and the safeguarding of civil liberties.

As the legal battles unfold, it remains clear that the courts and Congress will play pivotal roles in determining the extent of presidential authority and civil rights protection.

When a swag of unilateral executive orders can become law without consultation with the elected Government, then dictatorship prevails and Democracy has come to an end.

We do not need to do the same in Australia. This sort of behaviour from senior "polliticians" is my main reason for voting against Australia becoming a republic. Our form of govt has worked well for hundreds of years & really does not need to be changed.

I don’t like the man and, in my personal opinion, I believe he has a deep seated mental issue. Look at the ridiculous things he comes out with and now who he has beside him in his cabinet - other air-heads and moneyed men without brains to do good for people. He hated Dr Fauci because Fauci told it like it was.

He is building a so-called Republican Party of wanna-be ‘oligarchs’. As the song says “money talks” but in my opinion something will bring him and his cabinet of like-minded people crashing down with a great big thud.

However, I don’t think ANY of us can really talk about policies and laws in another country unless we’ve been in THAT actual seat of power but these are my opinions of the man. Try taking Greenland off another country just because you want it for your country’s security and what about the Panama Canal and the Gulf of Mexico. I’ve heard he’s also talking about wanting to take over Canada. These countries don’t belong to the USA just because he wants them! Just my hatred of the man and his supercilious airs! I have first cousins in the States who also hate him.

PLEASE, WE DON’T NEED TO FOLLOW ANY OTHER COUNTRY - the next we know we’ll all be whingeing all over again about our government when/if we follow the US.

And I also wonder what perceived benefits they can see if they go through the psychologial rethinks, plus the operations, plus the gender reassignment medications, plus the mental exertions prior to and after the experiment of making the change? And what happens if they don't like the result after all? No worries, the gummint will take care of me ...
It would be good if passports and other legal documents got rid of Male or Female, and instead read as Gender at Birth….

It’s all well and good signing all this stuff but how many of his orders will actually come to anything. He’s just flexing his muscles, he’s full of hot air. What happened to the wall he was building that Mexico were going to pay for during his last stint? Give it a few weeks and he will out of favour again. It happens to every leader/politican. As my mum used to say “all mouth and trousers” lol
A number of his signed so-called Executive Orders are already being contested, debated, looked into by legal authorities there and they DO have the power to overturn them. We don’t need to follow what I consider a ‘Demented’ man.

Stop and think, think, think very carefully next time you vote (no matter which party it is for) if we want to be like the Americans then we will be in the same state that country is going to be in in a few years.

We need to vote them all out and start from scratch. Vote someone in who has the balls to howl down the do gooders, reverse some of the blatent mistakes that have been made by previous weak, gutless Prime Ministers and take OUR Country back.

100% agree!!!! As far as I'm concerned, TERRORISM is the most important subject to deal with in ALL countries around the world NOW - and that's what Trump is doing, not bringing, like Biden and Albanese, over one million nobodies (mainly scum - that their OWN people will not take in).

They get priority assistance with housing, medical care and now food and medications, creating a shortage of the true civilians (especially the aged, disabled and veterans) who get second place by sleeping in tents, can't afford food and have to wait years or completely forego medical treatment!
Not to mention, episodes of attacks, vandalism and changes to our laws and customs!
