This was the tragic case for the family of Alan Edward Stewart, a 70-year-old man whose life was cut short due to a series of medical missteps following a routine colonoscopy at the Royal Melbourne Hospital in 2018.

Alan Stewart's story is a cautionary tale for all of us, especially as we age and become more reliant on medical services and advice. After returning an abnormal bowel cancer screening test, Mr Stewart underwent a colonoscopy, a common procedure that many over 60s might be familiar with. The procedure itself is typically quick, lasting about 20 minutes, and patients are usually discharged a few hours later, as was Mr Stewart.


However, the events that unfolded the next day highlight the critical importance of post-procedure care and the need for clear, accurate medical advice. At around 10:44 pm, Mr Stewart began experiencing alarming symptoms: abdominal pain, dizziness, and shortness of breath. His wife, Sherrilyn, did what any concerned spouse would do—she called the hospital seeking guidance.

The call was transferred to the Nurse-on-Call service, a telehealth line meant to provide expert advice. Despite detailing her husband's symptoms, the advice given was tragically inadequate. The nurse suggested Mr Stewart maintain hydration, take Panadol for the pain, and see a doctor within the next 12 hours. This advice, as we now know, was fatally incorrect.


Mr Stewart took the Panadol and went to bed, but by 3:15 am, he was found unresponsive by his wife. An autopsy later confirmed that he had died from a ruptured spleen—a condition that, had he received the right advice and immediate medical attention, might not have been fatal.

The coroner's report pointed to the nurse's incorrect advice as a critical factor in Mr Stewart not receiving the emergency care that could have saved his life. Coroner Paul Lawrie stated, 'Assessment and care may, subject to his clinical presentation on arrival at the hospital, have prevented his death.'

While no recommendations were made to Medibank Health Solutions Telehealth, which provides the Nurse-on-Call service, due to an internal review and subsequent changes, the coroner did make two recommendations to the Royal Melbourne Hospital. These included a review of the written patient discharge information to clarify what constitutes serious symptoms, particularly signs of significant internal hemorrhage, and to ensure a record is kept of all information provided to the patient upon discharge.


This heartbreaking incident serves as a stark reminder of the importance of clear communication between healthcare providers and patients, especially when it comes to understanding post-procedure symptoms and when to seek urgent care. It also underscores the need for vigilance on the part of patients and caregivers.

Without reading the whole post, it's very tragic someone loses their life over "Medical Missteps".

There are specialised solicitors who handle these sorts of cases for "Medical Negligence", if that's the case in this instance.

70 is not an old age to pass away through wrong medical procedures.

If I were a direct family member of the deceased, I'd be getting legal advice ASAP.

As a few of you already know I had surgery in November 2019. A simple gallbladder removal, then the surgeon decided to remove my umbilical hernia.

This was the start of my nightmare. The pain and infection was horrendous. The surgeon was a total arrogant asswipe.

I ended up seeing another surgeon who straight away put me on strong antibiotics

Cut a story short I had two more surgeries, one where the new surgeon did a detrivment and 5 days in hospital.
As infection was still there I needed more surgery, which resulted in losing my whole umbilicus and part of my abdominal wall. THE ORIGINAL SURGEON USED RECALLED MESH PLUS HE STITCHED THE MESH TO MY BOWEL.
My new surgeon was amazed I didn't get sepsis.

After 4 years and 8 months of going through pure hell I now suffer severe depression. I'm in pain due to nerve damage. The surgeon needed to put in alot of stitches and large stitches inside to pull my abdominal muscles together.

I can nolonger work. It's hard to bend down...I cannot pick my grandkids up.
I get exhausted quickly.

I did sue the original surgeon . It went to mediation , I got an ok payout but not as much as my Barrister thought. He wanted it to go to court but I didn't have the energy. I just wanted it finished.

This is not how I wanted my working life to end.

I now warn people . If you are not trusting your doctor get a second and even a 3rd opinion.
Some doctors think they are God but are far from it.

This arrogant asswipe of a surgeon has ruined my life yet he is still a practising surgeon.

I keep telling myself at least I'm alive and there are people worst off

I am so sorry for your loss, that is absolutely dreadful negligence on the part of the doctors and it needn't have happened. It does have to make you wonder!

I’m at a loss to know how this man sustained a ruptured spleen during a colonoscopy. A coroners enquiry should have been held as he died after an anaesthetic this would be mandated.

i have contacted many lawyers and it seems it is not worth while doing anything
what i have is proof in writing of the negligence from my wifes doctors and apparently doing nothing is classified as doing no harm by doing nothing
I wish these same people are in need of help and no one helps
