Should Uber drivers have the right to reject passengers because of weight?

A Melbourne man has accused Uber drivers of repeatedly refusing to pick him up—claiming it is because of his weight.

Each time he books a trip, he braces for the possibility that the driver will take one look at him and keep going.

For Martin, that gut-wrenching moment has become an all-too-familiar part of trying to get around the city.

Martin, who lives on a disability pension due to his size, said his experiences have left him feeling ‘less than a human being’.

‘It’s because of my size. I’m morbidly obese, I don’t shy away from that,’ he told #A Current Affair.

‘The drivers take one look at me and they go right past me.’

He said he had grown accustomed to watching a driver approach, only to have them turn away at the last moment.

When they reached the corner, they would cancel the trip—leaving him standing on the kerb with a hollow feeling in his stomach.

"It feels like I'm less than a human being. I want to be able to be like everyone else."

Martin, speaking to A Current Affair

Relying on rideshare services

Martin relied on rideshare services to visit his elderly parents, whom he cared for.

He said personal circumstances had prevented him from losing the amount of weight he wanted, despite his best efforts.

Under Victoria’s Equal Opportunity Act 2010, it is illegal to discriminate against someone based on their physical features.

The law also places a ‘positive duty’ on companies to take steps to eliminate discrimination in the workplace.

Businesses can be held responsible if their workers engage in discriminatory behaviour.

Martin said the problem was not confined to rideshare trips—he often felt judged while eating in public, walking through shopping centres, attending medical appointments, or even trying to get a haircut.

Taking action against discrimination

Over several years, Martin kept a record of every Uber driver who cancelled on him after seeing him in person.

When he complained to Uber, he claimed he was told that drivers would receive better training.

‘They occasionally send me a $10 voucher because that’s how much a human’s dignity is worth,’ he said.

Martin wanted the company to take action against drivers who discriminated against passengers based on weight.

He said he simply wished to be treated with dignity.

Did you know?

Australia’s National Obesity Strategy 2022-2032 Specifically identifies tackling weight stigma and discrimination as a key principle for creating a healthier Australia.

Uber’s response

Uber responded in a statement saying it had a ‘zero tolerance policy towards any form of discrimination’.

‘Our community guidelines clearly prohibit discrimination of any kind,’ an Uber spokesperson said.

‘We work to inform driver partners about those standards, hold them accountable for their actions, and make it clear that this behaviour can result in them losing access to the Uber app.’

Uber has been contacted for further comment.

What This Means For You

If you or someone you know faces discrimination when using rideshare services, you have options.

Document each incident, report to both the company and the Victorian Equal Opportunity and Human Rights Commission, and know that the law is on your side. Your experiences matter and your dignity is non-negotiable.

Oh sadly I am listening to the foul garbage and insults people are spewing. Mostly from a place of ignorance too.
Ok I will give you the benefit of the doubt. Pray tell where do you get your information from. Show me where morbidly obese is caused through medical rather than overeating and sitting around

Trust me at 85 I am a lazy lump. Yes a bit bony but as I said even doc can’t find an explanation with my weight never changing regardless
You just have a good metabolism

What on earth has that got to do with he horrid comments you are making about that man? Hmmmm? Just because you help some people does NOT give you free rein to be vile to others.
No one made horrible comments about this man . But only spoke the truth.

He should get his lazy arse up and start moving around and try to help himself.
Including asking for a van

Want to hear a rude comment.

Try getting an elephant 🐘 into a car

You can’t help yourself , maybe you need help yourself. No one has used the language you are spouting, members are just stating facts. So get over yourself.

No poppet ... YOU are the one who needs help and needs to learn compassion and kindness. That man may have medical conditions but you get up in your ivory tower and judge him ... shame on you! I would rather be kind and considerate to people like him than be bullied by the likes of you and others who are demeaning him. Now shoo ....

Just listen to yourself YOU are the nasty one you can’t accept others opinions, madam righteous.who gave you the right to dictate to others. Stop making assumptions and face facts .

On YouTube, Martin did mention that he doesn't have the means to help him address his issues, as he mentioned he is on a Disability Pension, which would mean he has access to the Public Health Services, it would no doubt take him months to see the appropriate Doctors, plus a referral to a Specialist which he couldn't afford. Perhaps his Doctor could help him in some way to get the right medical care via the Public Health System. This in turn would help Martin achieve his goals, thus giving him a new lease of life with a positive outcome... revitalized, new attitude, and back into the workforce as a new personality. Maybe even helping people with similar challenges.
In the meantime, regarding travel, I understand there are taxi vans available for people with Disabilities and in wheelchairs that transport them to and from appointments. Martin would have to check it out and contact the appropriate companies instead of calling Uber.
As Uber is aware of Martin's situation, they could refer him to other methods of transport, and happily give him their contact numbers, maybe even list the taxi van companies on their websites.

Like any business, they make the rules , he needs to stop whinging and work on the weight problem, stop feeling sorry for his dilemma .
Maybe he cannot fit into the uber drivers car? We need more information!

Maybe he should look at his diet and do some exercise, unless he has a medical issue , then that’s not an excuse to be overweight either , it can be controlled by his GP . No excuse .
Dear member Leenie, thankyou for your post. Sometimes people carry a gene that causes weight gain. Other than surgery, there no diet or GP that can over turn that gene that one is born with. Wishing you a pleasant evening. 🙏🦋

Two people that I know with an underactive thyroid are both skinny, one being my daughter the other an old work colleague.

That list doesn't state morbidly obesity though which is the topic of the conversation

Dear Suzanne, I am just going by what I read in medical books. The list there is stating that you don't have to be lazy or sitting on the couch endlessly to be obese. Your daughter is fortunare not be affected with obesity with her underactive thyroid, but she does not represent that majority of the public who are affected by obesity that have an underactive thyroid. I agree with all that you say as I know you are a kind and caring lady. I am only stating what I read in the medical books. Have a lovely evening. 🙏🦋

Please, if you have never had serious weight issues, don't talk about diets and GPs. Obesity is a disease that is not easily corrected. If it was as easy as doing excersises and going on diets, then no one would be obese. It is so easy to throw words at people who are ostracised from the community because of their weight. This man is going through hell with his weight issues. And his excuse could very well be a medical one. Wishing you a pleasant evening. 🙏🦋

SO! one can be on the disibility scam for being FAT.
This means half of australia must be collecting as well.
go and sit with a coffee and watch the fat people go by.
Being fat is being obese. Obesity is a disease, that one can be born with, do some research. 🙏🦋

Live the life and you can be so cruel. He is who he is and doesn’t deserve a strangers judgement,
Dear member Isis, you have provided the kindest post this evening. How quickly are skinny people to judge those over weight. Dear Isis, you know about care, empathy and you understand the kind of daily trauma this man is living with, on a daily basis and on top of that he is looking after his parents. Just reading some of the other selfless posts, makes me not feel so good. Many blessings to you dear Isis, 🙏🦋

Maybe he should inform himself of available options and not just complain about discrimination and expect to be treated as a normal person. There are plenty of avenues for assistance available to him so that he doesn't have to feel bad about his situation when he can't be accommodated as he wishes to be. The rest of the world is not at fault or responsible for his problems and should not be made to feel guilty for it.
He is not blaming tbr world, he is blaming these discriminating Uber drivers, who should have stopped and told the man that they would order a larger vehical to drive him. OMG all of a sudden everyone seems to be playing the role of the judge for obese people. If you don't have a medical degree, don't judge the obese people who struggle daily with this disease 🙏🦋
