Should Uber drivers have the right to reject passengers because of weight?

A Melbourne man has accused Uber drivers of repeatedly refusing to pick him up—claiming it is because of his weight.

Each time he books a trip, he braces for the possibility that the driver will take one look at him and keep going.

For Martin, that gut-wrenching moment has become an all-too-familiar part of trying to get around the city.

Martin, who lives on a disability pension due to his size, said his experiences have left him feeling ‘less than a human being’.

‘It’s because of my size. I’m morbidly obese, I don’t shy away from that,’ he told #A Current Affair.

‘The drivers take one look at me and they go right past me.’

He said he had grown accustomed to watching a driver approach, only to have them turn away at the last moment.

When they reached the corner, they would cancel the trip—leaving him standing on the kerb with a hollow feeling in his stomach.

"It feels like I'm less than a human being. I want to be able to be like everyone else."

Martin, speaking to A Current Affair

Relying on rideshare services

Martin relied on rideshare services to visit his elderly parents, whom he cared for.

He said personal circumstances had prevented him from losing the amount of weight he wanted, despite his best efforts.

Under Victoria’s Equal Opportunity Act 2010, it is illegal to discriminate against someone based on their physical features.

The law also places a ‘positive duty’ on companies to take steps to eliminate discrimination in the workplace.

Businesses can be held responsible if their workers engage in discriminatory behaviour.

Martin said the problem was not confined to rideshare trips—he often felt judged while eating in public, walking through shopping centres, attending medical appointments, or even trying to get a haircut.

Taking action against discrimination

Over several years, Martin kept a record of every Uber driver who cancelled on him after seeing him in person.

When he complained to Uber, he claimed he was told that drivers would receive better training.

‘They occasionally send me a $10 voucher because that’s how much a human’s dignity is worth,’ he said.

Martin wanted the company to take action against drivers who discriminated against passengers based on weight.

He said he simply wished to be treated with dignity.

Did you know?

Australia’s National Obesity Strategy 2022-2032 Specifically identifies tackling weight stigma and discrimination as a key principle for creating a healthier Australia.

Uber’s response

Uber responded in a statement saying it had a ‘zero tolerance policy towards any form of discrimination’.

‘Our community guidelines clearly prohibit discrimination of any kind,’ an Uber spokesperson said.

‘We work to inform driver partners about those standards, hold them accountable for their actions, and make it clear that this behaviour can result in them losing access to the Uber app.’

Uber has been contacted for further comment.

What This Means For You

If you or someone you know faces discrimination when using rideshare services, you have options.

Document each incident, report to both the company and the Victorian Equal Opportunity and Human Rights Commission, and know that the law is on your side. Your experiences matter and your dignity is non-negotiable.

I think his expectations are unreasonable in my opinion, although I do feel sorry for him. He is quoted as having said, "I want to be able to be like everyone else." I think that might be almost an impossibility to achieve in a general sense given his condition. The only thing that I can possibly suggest for him is to seek help and advice from disability experts and consultants who would be able to provide advice to suit his needs.
he already is under them.

My sympathy would lie with Uber drivers because some of this persons comments and expectation to be treated as a normal person are quite unreasonable. I think that Uber needs to implement standards for meeting people with disabilities needs and ensuring that they actually dispatch a suitable form of transport to meet those person's needs, not just expect their driver to sort out the problem and chastise them for complaints being lodged. My opinion would be that Uber as the employer is responsible to ensure they have all the facts from the customer and have suitable transportation equipment dispatched to meet the needs of the customer with disabilities. I abhor an employer who does not support their employees appropriately to enable them to do their job properly.
i do not call being fat a disibility.
one becomes fat by putting rubbish in the north and south.

When my daughter turned 45yrs old she thought she best get life insurance so she rang a leading provider. The guy said sure no worries what do you weight (she was quite a big girl back then) when he heard how much she weighed he said he was sorry but she was too fat to get life insurance 😞. In today's society there are so many big people as they stay home alot. Since Covid.

Not being difficult but I honestly havnt seen that percentage, may I ask where the info came from?
She made it up. People are so rude and judgmental these days, and make up figures to justify their bias and prejudice. I am shocked by the rudeness and lack of compassion in some of the comments here!

You are also judging people , you. Can’t sugar coat others problems .
Sadly yours is the typical comeback when someone is called out for their lack of compassion. Act like a rude and horrid person who is lacking in basic humanity, and you must expect to be called out on it.

I hear how this man must feel as he is left like a piece of rubbish on the kerb. I also hear the drivers and the problems that have been noted. I would like to think he could get a little van for people with special needs either weight or equipment and a caring driver who would be there for him.
He actually can request one through uber

The primary cause of morbid obesity is an imbalance between calorie intake and energy expenditure, leading to excessive fat storage. This imbalance is often a result of consuming more calories than the body can burn through physical activity and daily functions. While genetics and certain medical conditions can play a role, lifestyle factors like diet and exercise habits are the main drivers of morbid obesity around 84.5%

Here's a more detailed breakdown:
  • Energy Imbalance:
The fundamental cause is consuming more calories than the body uses, leading to fat storage.

  • Diet:
High consumption of energy-dense foods, especially those high in fat and sugars, contributes to weight gain.

  • Lack of Physical Activity:
Sedentary lifestyles and reduced physical activity mean fewer calories are burned, further contributing to fat storage.

  • Genetics:
While not the primary cause, genetics can influence a person's predisposition to weight gain and how their body stores fat.

  • Medical Conditions:
Certain conditions like hypothyroidism, Cushing's syndrome, and polycystic ovary syndrome can also contribute to weight gain around 10% of morbidly obese people

I'm thinking you may be morbidly overweight and is the reason behind you being rude and not opening your eyes up to the truth

You just have to google search and you will see it is actually a very small amount of people that are morbidly obese because of a medical condition.

You know nothing about me , so keep you judgment to your self, I have helped many people including families who have been in DV situations. The last one cost me over$900 after the damage to my home by her daughter. Judge not lest you be judged .

My uncle was obese and it was his fault. He would sit down and eat awhole bucket of KFC plus drink a 2 litre coke.
He ended up with diabetes abd in the end needed a leg amputated.
He also ended up with heart problems and needing surgery.

His surgeon said he needed to change his life style and the way he ate.

The Dietician at St George hospital also confirmed this.

Both told me most people who are morbidly obese is through eating.

My great grandmother was a very large lady and was told hers was medical but to be honest I don't think it was. My aunty said she was a big eater.

I told my uncles surgeons about her and that's when they replied that my uncles wasn't medical but what he consumed.

So over weight people are not just harming themselves they are costing tax payers awhole lot of money in paying their medical cost

What on earth has that got to do with he horrid comments you are making about that man? Hmmmm? Just because you help some people does NOT give you free rein to be vile to others.
