The woman says she almost had a ‘heart attack’ when her husband showed her the fine.

According to the local council, the infringement notice was for ‘stopping on or across a driveway unless dropping off or picking up passengers’.

Despite the explanation offered, she still found the reason unclear. And honestly, same here!

‘I didn’t understand it. We couldn’t figure out why.’ the woman said in confusion.

‘I see people parked like this all the time,’ she added.



The woman went to Facebook and posted in a local group to explain her situation, and it was there other residents pointed out that the car was positioned just a bit over her curb and into the public domain for pedestrians.

According to the parking rules and fines section of the Queensland Government’s website, drivers should not ‘park or stop on a road in a way that blocks access to a path or driveway unless…. you are dropping off or picking up passengers within 2 minutes of stopping’.

Despite the explanations offered by other locals, the woman is set on contesting the fine that she deems is ‘very unfair’, pointing out how other locals did not know of the rule as well.

She said she also feels like she should have gotten a warning first rather than fined right away.



The Logan City Council has yet to address the matter directly.

An unnamed council spokesperson, however, told 7News.com.au that they receive many complaints over improper parking, including circumstances similar to this anonymous woman that endanger pedestrians by forcing them to use the road to pass by.

They said: ‘Queensland road rules state that a driver must not stop on or across a driveway or other way of access for vehicles travelling to or from adjacent land unless there are certain circumstances which apply.’

This is ludicrous, people park on driveways like this everywhere, everyday!! Also, pedestrians would NOT have to go onto the road to walk behind the car…unjust!!

I'm all for this rule which has been in effect all over Qld for years. I don't drive but I truly wish the council would get onto the case of some residents in my area and slap some fines on their cars. On more than one occasion I have had to go out onto the road to get around a car and that's not an easy thing to do when you are pushing a pram or someone in a wheelchair.

It is a rule basically practiced with a lot of local councils that if you park in the driveway but outside the property line you are in the public domain and therefore obstructing pedestrians or other users, there does not need a footpath to be there. Most people usually place their mailbox on their front property line so if your vehicle overhangs that line you can be up for a fine.

Providing there was a footpath on the other side of the street for pedestrians l would consider this one to be unreasonable. I seem to remember reading somewhere that a footpath should be used if provided. Crossovers are sometimes not kept tidy, no grass etc due to water restrictions which have existed for several years & can hide little surprises in the soil which can trip someone up.

The problem that used to exist in our street with a footpath on the other side of the road only, was tenants from the rental parking on the footpath impeding pedestrians. This ceased when the Ranger fined them. In this situation they deserved to be fined but not with the lady in the article l feel.

We have a neighbour who habitually parks over the footpath, complaints are unanswered, but he is a Gold Coast council employee. I, unfortunately, have to use a mobility scooter and am forced onto the road when returning home

Local Councils waste so much money that they have to recoup this waste any way they can. A fine of $96 is way out of proportion to the infringement.

I think it is wrong as there is no footpath along that area I can see and it does not protrude onto the road

If the council want to inflict this rule they should provide a defined foot path so boundaries are known. Looks like a person can walk around without going on the road. This is a grey area in many division. infringement rules should be issued with rate Notices so everyone knows. Mobility scooters capable of exceeding 25 kms should be on the road and not the grass?? Another grey area? A warning would have been more apt not money grabbing.

He is in a sense breaking Council By- Laws. Being an employee of the said council doesn't give him the right to flaunt the regulations. Rangers are also at fault because they are aware of this situation, know who owns the vehicle & both therefore are not adhering to the set RULES FOR AN EMPLOYEE OF THE COUNCIL which the are bound by in their employment. Has this matter been addressed to the Council CEO directly or your local politician?
