Aged care reforms delayed after sector raised survival issues

The biggest reforms in aged care in about three decades have been delayed by a few months, as the federal government moves to allay concerns from the sector, which had been sounding the alarm about the "drop dead" issues involved for providers if they had pressed ahead.


The changes were due to come into effect next month, but in what the opposition labelled an "embarrassing backflip" the government has pushed the date back to November.

The reforms address recommendations of the royal commission into the aged-care industry, but the rushed timeframe to implement them had drawn criticism from the sector, which argued it was "near impossible".

Health and Ageing Minister Mark Butler said the government had listened to the sector in providing the extension.

"We need to think about a delay of a few months to ensure that all of the systems are in place to deliver a smooth transition to the new laws, and also that older Australians are fully informed about what those new laws will mean for them," he said.

"Nonetheless, what we see into the future is a once-in-a-generation reform to the aged care system that will deliver high quality, world class aged care services to older Australians who have built this community."

The sweeping changes will mean Australians entering the aged care system will have to make larger means-tested contributions to their care.

However, a "no worse off" principle means the contributions of anyone already in the system will remain unchanged.

A new Support at Home program will also be implemented under the changes, as the government aims to help more people stay in their homes for longer.

Extension welcomed by peak body

Ageing Australia Chief Executive Tom Symondson said providers were "relieved" with the extension, saying it would avoid "drop dead issues".

"The types of issues that would have led to a provider not being paid for a couple of months, or receiving less money than they needed to operate potentially for an extended period, systems collapses that might have meant the bills didn't come out," he said.

"We were really worried that we would trip over the reform and our organisations would essentially not be able to cope. Now, many would have done, this was never going to be a cataclysm, it was never gonna be the end of the world, but there was just too much risk that older people would suffer."


Mr Symondson said the additional time would give the sector critical space to finalise agreements, but cautioned the time extension would not necessarily mean there would be no teething issues once the changes kicked in.

"We wouldn't say that another three months, everything will be perfect, there will still be problems, there are still issues that will probably be working out for months or years into the future," he said.

"But some of those really critical 'can we even deliver care?' type questions will be hopefully resolved and we're going to focus on that, we're not going to take our foot off the pedal."

The Older Persons Advocacy Network (OPAN) chief executive Craig Gear said he "reluctantly" supported the delay.

"Over the past weeks, it has become increasingly apparent that, while the macro design of the reform is solid, older people don't have the necessary information to make informed choices at an individual level, particularly around the new Support at Home program," he said.

"We are also concerned that the appropriate systems aren't yet in place to ensure continuity of care and services for older people during the transition."

Shadow Health Minister Anne Ruston said it was the "right decision" for older Australians, but accused the government of having "refused to listen to the concerns" of the sector.


"Today's embarrassing backflip by the Albanese Labor government on the delivery of their aged care reforms is a clear admission of failure — and one that could have been avoided," she said.

"This refusal has created months of stress and uncertainty for providers and older Australians, only for the government to now backdown with little more than three weeks to go until their deadline."

Treasurer Jim Chalmers said while the delay was "modest", it would likely result in a loss of revenue of $900 million over the next four years, because it delayed the requirements for wealthier older Australians to pay more for their care.

"We've done this in good faith, out of necessity. It wasn't ready to go and so we have got a responsible delay here," he said.

The federal government had already moved on other recommendations of the royal commission, including a requirement for all facilities to have a registered nurse on duty at all times, and improving the rules governing providers.

When unveiling the reforms last year, the government said they would save $12.6 billion over 11 years.

I get my food from LitenEasy. Brilliant food and choice of size meals to suit you. If on a package you are supposed to pay 30% and the rest from your package money. I wish it worked that way. Invoice from food company shows overall cost of order, what we pay plus what should come out of your package money. I told my lady from food company what I've been charged by FGF and her shocked reply was "you'd be better off buying straight from us". FGF charges me more than the original bill.
Yesterday's invoice from FGF has me charged for 4 appointments with my Psychologist for the month. I've had her for 2 years and NEVER had more than 2 appointments in any one month. This is the second time they've done this.
Then we come to details for my carer who I've had for around 7 years but known many more. My invoice shows visits for the last month BUT in the middle of this are dates for 2023 and 2024.
I am so sick of me and the government being ripped off. I might be 83 with a body breaking down but the brain is still as sharp as ever.
I hear you say "change providers" but sadly I brought mt carer to this company and she needs the hours but we are looking at an alternative.
As for everyone needing a community nurse. I've got one but SHE IS WELL OVER 1000 ks away in NSW and tries to tell me there isn't anything wrong with what I'm being charged. One of the things I am very good at is account keeping including having had my own businesses.
This is really getting my back up and thought you should know what's going on. I know I'm not the only one in my town copping this.

Speak up, contact your local member, make waves. The loudest usually get attention first. It's not just yourself that you are advocating for. Stay strong.
 
To southmelbswans... I received a gov letter re the changes a while back, completely confused me. SDC did a story a couple of weeks ago on the changes and what it all means and I found it had more info and understood the changes much better. That is not to say still a bit confusing.
To gamily...glad I did not choose FGF when recommended to me a couple years ago. I chose another company who until this year had been fantastic. From accounts to carers, care managers, consistency they were great, but now have recently been taken over and things are not the same. I too check statements and has not been a problem there with my provider. I urge you if possible change your provider or put things in writing to your care manager. The problem with all providers today are they are so understaffed and lack the career staff who have accreditation for higher needs. Therefore, you end up with a carer who is only accredited for doing domestic work but who are scheduled on for you to do social support...not trained for that.

sadly our local members are useless. I spoke to the one for Qld and I got reply "not much I can do about it" and the Federal one was a cop a few years ago and had an innocent man jailed for a murder he didn't commit because he and his cousin (also a cop) couldn't prove it was the one who DID do it. I gave them all the proof and they just laughed at me. The innocent man did 15 years and got out finally last year. I wouldn't trust him with a can of worms. Any wonder why I call this town BLUNDERBURG.

Thankfully I knew my carer many years before she came to me and there's no=one better than Danni but as for the care manager whoever that is, I've even sent emails to the owners and everything ends up with the community nurse who I now refuse to speak to. I am well aware of others in this town who have the same problems to me and thankfully I've also got the Advocate on side with me. I contacted the Federal minister and after a couple of months ask if I was happy with the outcome of what she'd done.....WHAT SHE'D DONE WAS MY OWN WORK which included State and Federal Parliament. Thank you very much ANIKA WELLS.
As many of you realise I''m not afraid of the truth. I even brought my kids up with "IF IT'S NOT TRUE, DON'T SAY IT". I take pride having been a JP since 1996 so I don't take kindly to BS.

believe you, I have a identical storey...they mow my lawns for $1500 ea month, I used to pay $140 every 6 weeks before I got on this plan...become a provider , its better than winning lotto

Please tell me how.... we've actually got this is mind but not sure how to go about it. So far we've got Danni, our Advocate, a Psychologist and at least 5 people like me. All we are looking for is how to make it happen.

Reading gamiry’s comments you are so spot on . Everyone shoul check the paperwork . I am 87 years old and blind . I need carer to take me everywhere I go . I am slower walking than i used to be but my brain is still working well for my age . The paperwork my provider sends to me for what they are charging for services provided is sometimes 3 months behind . Have level 3 homecare plan so was very surprised as how little funds I had in my package. Each time I go to doctors appointments I am allowed 1 hour minimum and 3 hours maximum ,however the last 3 appointments with my dr. I have rang my provider they have had no one to take me .Their excuse being we are short staffed! Have 5 people off sick and on holidays and we just can’t get staff. Fotuneately I have 1good Neighbour and 1 good friend that lives close by and they have taken me . I offer to pay them but they won’t take any money , they always say we are friends and friends do not take money . When I received my last account my provider is charging me for services that they can’t provide . This idea of keeping people in their own homes yes very good but their are too many loopholes in the system and the taxpayers are footing the bill.. Remember Geoffrey Eddllestone when Medicare was started , he is just the first one came to mind that ripped off the system
 
I’m beginning to dread reaching the stage where either of us need help. I have a few friends with packages & the charges for nurses, gardeners etc are astronomical, I actually couldn’t believe it, $94 an hour for a gardener, we employ him privately & pay him $50 per hour. I‘ve heard of gardeners who won’t weed, only mow lawns & never seem to find the one at the back, cleaners who don’t clean anything and the list goes on. My mum did everything herself until she died, so l really hope that I can too. It’s the major aspect of aging that really worries me. Best of luck to Gamiry and everyone else who is having problems.

The Government should provide ONE database which has a billing system that works with rotas for services and care providers (of those available at the moment none of them do that which leads to all the errors with billing). Then the providers should just pay a levy a year to buy onto that data base. If things were done correctly, services and service providers checks (police checks, insurance cover, professional qualifications etc) could all be held in one place - that would cut the need for the number of back office staff who spend ALL YEAR chasing providers for the information (some of whom are not helpful).

All these delays could have been largely avoided if the Government had done this as part of the implementation to change. (Ex worker in Aged Care)

That sounds way too sensible, no government could handle that, let alone think it. I usually say, just ask the people who work in these places what needs to be done to improve things, but that doesn’t happen either.
 
I've had a carer come and sit with me for three hours a week for the last four years, now out of the blue they tell me that my new unasked carer will be changing in a couple of weeks, I told that if I lost the lass I have then they stick it up where the sun don't shine.
